ProSwing AI Terms of Use

1. Acceptance of Terms

By downloading, installing, or using ProSwing AI ("the App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and True Compass AI. If you do not agree to these Terms, do not use the App.

2. Description of Service

ProSwing AI is an AI-powered golf swing analysis application for iPhone. You record your golf swing using your device camera; the App analyzes it using artificial intelligence and provides personalized coaching feedback including written analysis, biomechanics scores, key frame breakdowns, and optional voice coaching. On supported devices (iPhone with LiDAR), the App uses ARKit for 3D body tracking to provide more detailed biomechanics measurements.

3. Subscriptions and Payments

ProSwing AI offers the following subscription plans, billed through the Apple App Store:

Billing: Payment is charged to your Apple ID at confirmation of purchase. The annual plan includes a 7-day free trial for new subscribers; after the trial, $79.99/year is charged.

Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable plan rate.

Managing and Canceling: Manage or cancel your subscription at any time through Settings > Apple ID > Subscriptions on your iPhone, or within the ProSwing AI app under Settings > Manage Subscription.

Swing Limits: On the Monthly plan, unused swings do not roll over. The count resets at the start of each new billing period based on your subscription renewal date. The Annual plan has no swing limit.

Refunds: All purchases are processed by Apple. Refund requests must be submitted to Apple at reportaproblem.apple.com in accordance with Apple's refund policies.

4. Free Tier

New users receive 5 lifetime swing analyses at no charge. These 5 free swings are tracked to your Apple ID via iCloud and are not reset by deleting and reinstalling the App. After 5 free swings, a paid subscription is required to continue using coaching features.

5. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, for personal non-commercial use, in accordance with these Terms and Apple's Usage Rules.

6. User Content

You retain full ownership of your golf swing videos and any content you create through the App. By using the App, you grant True Compass AI a limited, non-exclusive license to process your videos and biomechanics data solely to provide you with swing analysis and coaching feedback. We will not share your videos with third parties except as required to deliver the service (see our Privacy Policy).

7. Acceptable Use

You agree to use the App only for personal golf swing analysis. You agree not to:

• Use the App for any unlawful purpose or in violation of applicable laws.
• Attempt to bypass subscription limits, session counts, or free-tier tracking.
• Reverse engineer, decompile, or disassemble the App.
• Interfere with the App's servers or infrastructure.
• Upload content that is illegal, harmful, or infringes on others' rights.
• Share your account access with other individuals.

8. AI Coaching Disclaimer

The swing analysis, scores, coaching feedback, and recommendations generated by ProSwing AI are produced by artificial intelligence and are provided for informational and recreational purposes only. This content:

• Is not a substitute for professional golf instruction from a qualified PGA instructor.
• Is not medical, athletic training, or physical therapy advice.
• May contain inaccuracies or limitations inherent in AI technology.
• Should not be relied upon as the sole basis for changing your golf technique, especially if you have any physical injury or health concern.

Always consult a qualified golf professional or physician before making significant changes to your technique or if you have health concerns related to physical activity.

9. Account Deletion

You may delete your account and all associated data at any time using the "Delete My Data & Account" option in the App's Settings screen. If you have an active subscription, you must cancel it separately through Settings > Apple ID > Subscriptions to stop future charges — account deletion within the App does not automatically cancel your App Store subscription.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that analysis results will be accurate in all cases.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUE COMPASS AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.

13. Changes to These Terms

We may update these Terms as the App evolves. Material changes will be communicated through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
