ProSwing AI Beta License Agreement

1. Acceptance of Terms

By downloading, installing, or using ProSwing AI ("the App"), you agree to be bound by this Beta License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

2. Beta Software

ProSwing AI is currently in beta testing. This means:

• The App is provided for testing and evaluation purposes.
• Features may be incomplete, changed, or removed at any time.
• The App may contain bugs or errors that could affect performance.
• Service availability is not guaranteed during the beta period.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial testing and evaluation purposes during the beta period.

4. User Responsibilities

As a beta tester, you agree to:

• Use the App only for its intended purpose of golf swing analysis.
• Provide feedback on bugs, issues, or suggestions when possible.
• Not redistribute, sell, or share access to the App with unauthorized users.
• Not attempt to reverse engineer, decompile, or modify the App.

5. User Content

You retain ownership of all content you create or upload through the App, including golf swing videos. By using the App, you grant us a limited license to process your videos solely for the purpose of providing swing analysis feedback. We will not share your videos or analysis data with third parties except as necessary to provide the service (see our Privacy Policy).

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The swing analysis and coaching feedback provided by the App is generated by artificial intelligence and should not be considered professional medical or athletic advice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. Our total liability shall not exceed the amount you paid for the App (which during beta is $0).

8. Termination

We may terminate your access to the beta at any time, for any reason, without notice. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.

9. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App after changes constitutes acceptance of the updated terms.
